Welcome to StudyVox. The websites accessed at www.studyvox.co.uk and www.studyvox.com and all the facilities and features made available on those websites including message boards, blogs and forums ("StudyVox Services") can only be accessed and used by you if you agree to do so in compliance at all times with these Terms of Use. By accessing and using the StudyVox Services (whether simply browsing as a guest or if you have registered as a member with us) you agree that you have read and agreed to be bound by these Terms of Use. If you do not agree to be bound by our Terms of Use you should stop accessing and using the StudyVox Services immediately.

We are entitled to change and update any part of these Terms of Use at any time without giving you prior notice, but we will post any changes to the Terms of Use onto this area of the StudyVox Services and those changes will be effective from the time they are posted. Your continued use of the StudyVox Services after we have posted any such change will indicate that you accept the new Terms of Use.

These Terms of Use, our Privacy Policy referred to below and also the Bursary Rules govern the whole arrangement between you and StudyVox. If any part of these Terms of Use, the Privacy Policy or the Bursary Rules are found to be invalid or unenforceable then the remaining provisions shall remain in force between you and StudyVox.

About Us

The StudyVox Services are provided and operated by StudyVox UK Limited, which is a company registered in England and Wales (under company registration number 06791259) and which has a registered office at 71 Duke Street, Mayfair, London W1K 5NY ("us", "we", "our" or "StudyVox UK").

Your Account

The StudyVox Services are intended only to be used by people aged 15 years old or older and who are in higher education. If you are younger than 15 years old, are not in higher education or are required to register as a sex offender you are not authorised to access or use the StudyVox Services.

There are certain parts of the StudyVox Services which can only be accessed and used if you are registered with us as a member. You will only be able to register with us as a member if you are aged 15 years old or over. By registering or attempting to register with us as a member you represent and warrant to us that:

  • you are aged 15 years old or over;
  • that the information you provide to us is true and accurate; and
  • your use of the StudyVox Services is not in breach of any applicable laws or regulations.

 

If we suspect at any time that any of the above is not the case we may, at our discretion, bring to an end your membership and permission to access or use the StudyVox Services immediately.

On registering with us as a member you will be asked to choose a username and a password. You are only entitled to register once with us and so use only a single username and password at any one time. You will always be responsible for any access or use of the StudyVox Services made using your username and password. Do not allow someone else to access or use your account and do not access or use someone else's account. You must not disclose your password to anyone. If at any time you suspect that someone is making unauthorised use of your account or password please contact us at admin@studyvox.com.

We may, at our discretion, refuse to register or deactivate at any time an account using a username or password which we believe is:

  • defamatory, obscene, unlawful or offensive;
  • infringing of someone else's rights;
  • a duplicate of an existing member; or
  • breaches these Terms of Use.

At any time you may cancel your account by clicking Account Cancellation, but please be aware that if you do cancel your account your access to certain parts of the StudyVox Services will cease immediately. Even if you cancel your account with us, certain provisions of these Terms of Use such as the sections headed Our Liability, Your Indemnity and Applicable Laws will continue to apply.

Your Use of StudyVox Services

We permit you to access and use the StudyVox Services on the understanding that it is only available for your personal use and not for promotional or commercial use and that you agree to comply with all applicable laws and regulations.

Any data, text, photos, audio or video, music and any other material of whatever type or medium which you upload, post, link to or share in any way using the StudyVox Services ("Your Content") will be your responsibility and any rights (whether intellectual property rights or otherwise) in Your Content will remain owned by you at all times. By uploading, posting, linking to or sharing Your Content you grant to us a licence which is worldwide, non-exclusive, royalty-free (and which includes the right to sub-license or transfer the same to the extent required for operating the StudyVox Services) allowing us to use, modify, publish, reproduce, store and distribute Your Content only in connection with the StudyVox Services. This licence will terminate if you remove Your Content from the StudyVox Services, except that you agree that the licence will continue solely with respect to other users' continued use of any of Your Content that you may have shared with or made available to them. You represent and warrant that you are entitled to grant this licence to us without being in breach of any applicable laws or regulations or the rights of anybody else.

By accessing or using the StudyVox Services you agree that you will not:

  • breach any applicable laws or regulations;
  • submit Your Content or act in any manner which is unlawful, infringing of others rights (including without limitation intellectual property rights), fraudulent or misleading, racially or ethnically objectionable, obscene, indecent or inappropriate, harassing, abusive or harmful to others;
  • solicit or use personal details from other users of the StudyVox Services for any purpose other than might be reasonably expected or has been authorised by another user of the StudyVox Services;
  • reformat, reverse engineer, tamper with or alter any part of the StudyVox Services or transmit any material containing a software virus or any other program or code designed to disrupt, destroy or interfere with the StudyVox Services or any other computer or telecommunications systems or software; and
  • attempt to gain access to StudyVox's servers, computer or telecommunications systems or use the StudyVox Services in a way which is designed to disrupt, destroy or interfere with other users content or enjoyment of the StudyVox Services including any use designed to disable or overburden the systems used to operate the StudyVox Services.

StudyVox is not responsible for the use that other users make of the StudyVox Services. StudyVox is not obliged to monitor, edit or approve any use of, content on or conduct in connection with the StudyVox Services, but is entitled at any time and at its own discretion to remove any content or deactivate any users account.

Our Content

All material, content and trade marks or logos on the StudyVox Services, except for Your Content, and all intellectual property rights in the same are owned by or licensed to StudyVox and are protected by the applicable intellectual property rights and laws.

Except for the authorised use of the StudyVox Services in accordance with these Terms of Use you agree not to copy, translate, modify, distribute, publish, sell or make any other unauthorised use of the materials, content and trade marks or logos on the StudyVox Services.

We may change the content or format of the StudyVox Services at any time.

Your Personal Information

We collect personal information about you for the purposes of providing you with the StudyVox Services. Our collection and use of your personal information is carried out in compliance with our Privacy Policy which you can access via this link and by agreeing to these Terms of Use you also confirm that you give your consent to our collection and use of your personal information as set out in our Privacy Policy.

We will never ask you for your account information, password or other confidential information by asking you to visit a web page or by emailing you. If you receive such a request please contact us at any of admin@studyvox.com.

Safety and Behaviour

Social networking is a fun way of staying in touch with old friends and making new ones, but any use of the internet needs to be enjoyed responsibly and with awareness of some important safety considerations. Just remember:

  • Not everyone on the internet is who they say they are or seem to be so always be careful about how you interact with others using the internet and the information you exchange as well as the information you rely on;
  • Don't give out personal information such as your mobile telephone number, personal email address, home address or details about your routine - by using the message boards and chat rooms of a good social networking site such as the StudyVox Services you should be able to safely chat to others without giving access to this type of personal information;
  • You should never feel harassed or bullied in any way whilst using the StudyVox Services and if for any reason you do please contact us at at any of admin@studyvox.com;
  • Be very careful about visiting websites that someone else has sent you a link to as they might turn out to be for a website involving virus' or offensive or disturbing content; and
  • We strongly advise you never to meet anyone that you only know from the internet. However, if you do decide you to meet with someone make sure you only do so in a very public place, NEVER go alone and always make sure other people know where you are going, who you are supposed to be meeting and when you plan to be back. If someone genuinely wants to be your friend they will understand and won't mind that you have other people with you.

Our Liability

ANY CONTENT, ADVICE, COMMENTARY OR OTHER MATERIALS WHICH IS MADE AVAILABLE AS PART OF THE STUDYVOX SERVICES DOES NOT FORM ADVICE ON WHICH YOU SHOULD PLACE RELIANCE.

USE OF THE STUDYVOX SERVICES IS ENTIRELY AT YOUR OWN RISK. STUDYVOX IS NOT RESPONSIBLE FOR, WILL NOT BE LIABLE FOR AND DOES NOT ENDORSE ANY OF THE CONTENT, ADVICE, COMMENTARY OR MATERIALS MADE AVAILABLE AS PART OF THE STUDYVOX SERVICES. STUDYVOX IS NOT RESPONSIBLE FOR AND WILL NOT BE LIABLE FOR THE ACCURACY, COMPLETENESS, RELIABILITY OR FITNESS FOR PURPOSE OF ANY OF THE CONTENT, ADVICE, COMMENTARY OR OTHER MATERIALS MADE AVAILABLE AS PART OF THE STUDYVOX SERVICES AND NOR CAN IT GUARANTEE THAT THE STUDYVOX SERVICES WILL BE AVAILABLE UNINTERRUPTED OR FREE FROM ERRORS OR VIRUSES.

STUDYVOX EXPRESSLY EXCLUDES ALL CONDITIONS, WARRANTIES AND OTHER TERMS WHICH MIGHT OTHERWISE BE IMPLIED BY STATUTE OR COMMON LAW.

WHETHER ARISING IN CONTRACT (INCLUDING FUNDAMENTAL BREACH), IN TORT (INCLUDING NEGLIGENCE), IN COMMON LAW OR BY REASON OF STATUTORY BREACH STUDYVOX EXPRESSLY EXCLUDES:

  • ANY AND ALL LIABILITY FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE INCURRED OR SUFFERED BY ANY USER IN CONNECTION WITH THE USE OR AVAILABTILITY OF THE STUDYVOX SERVICES, ANY WEBSITES LINKED TO IT OR ACCESSED VIA THE STUDYVOX SERVICES OR ANY CONTENT, ADVICE, COMMENTARY OR OTHER MATERIALS MADE AVAILABLE USING THE STUDYVOX SERVICES; AND
  • ANY AND ALL LIABILITY FOR LOSS OF PROFITS, LOSS OR CORRUPTION OF DATA OR MATERIALS, LOSS OF BUSINESS OR CONTRACTS, LOSS OF GOODWILL OR REPUTATION AND LOSS OF INCOME OR REVENUE HOWEVER ARISING.

NOTHING IN THESE TERMS OF USE EXCLUDES OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION OR ANY OTHER MATTER WHICH WE ARE NOT PERMITTED TO EXCLUDE AS A MATTER OF APPLICABLE LAW.

Your Indemnity

You agree to indemnify us and keep us indemnified in full against any and all losses, claims, actions, costs and expenses (including legal costs on a full indemnity basis), damages and any other liabilities incurred or suffered by StudyVox arising from or in connection with your use of the StudyVox Services, the posting of Your Content, any breach by you of these Terms of Use, any breach by you of any applicable statute or regulation or any infringement by you of the rights of any other person.

Other People's Websites

The StudyVox Services may include links to websites of other parties as a result of automated search facilities, but these links do not mean that StudyVox endorses or in any way guarantees those third party websites or any of the goods or services offered on them. The StudyVox Services may also include links to other websites and services operated by StudyVox which will be subject to their own Terms of Use and Privacy Policies which you should make yourself aware of prior to accessing or using them. StudyVox will not be liable for any content or any of the goods or services on any third party websites or websites which are not those from which the StudyVox Services are made available.

Applicable Laws

These Terms of Use and the Privacy Policy are governed by the laws of England and Wales and you and StudyVox each submit to the non-exclusive jurisdiction of England and Wales. If your membership (or application for membership or to open an account) is prohibited by any applicable laws and/or regulations it will be considered void by StudyVox.
